Terms of Service

The agreement between Climate Support and every farm, laboratory, packager, and shop that uses the platform.

Draft for legal review — details shown in [brackets] are still to be confirmed by Climate Support before this document is final.

01The agreement

These terms are a contract between you and Climate Support (“Climate Support”, “we”, “us”), [registration number], . They govern your use of the Climate Support platform at https://app.climate-support.org (the “Platform”), including the produce passports it publishes. By creating an account, activating an invitation, or using the Platform you accept them. If you do not agree, do not use the Platform.

You must be at least 18 years old and using the Platform for a farm, laboratory, packaging, retail, or similar business. If you act for an organisation you confirm that you are authorised to bind it, and “you” includes that organisation.

02Accounts

  • Give accurate information when you sign up or apply, and keep it current in your settings.
  • Keep your password private. You are responsible for everything done through your account until you tell us it has been compromised.
  • One person per account. Do not share credentials or let someone else act as you.
  • Accounts for laboratories, packagers, shops, and administrators are created by invitation. An invitation is personal to the email address it was sent to.
  • We may suspend or close an account that breaks these terms, that is used fraudulently, or that has been inactive for an extended period, after giving notice where practical.

03What the Platform does

The Platform coordinates a verification chain: a farm applies and is reviewed, harvests are logged as batches, an independent laboratory tests a sample from a batch, the result is bound to a QR code printed on the packaging, and a shopper who scans the code sees the batch’s passport. Climate Support operates the Platform, reviews applications, assigns laboratories, issues QR codes, and decides when a passport becomes public.

The Platform is an information and coordination service. It is not a food-safety certification, a regulatory approval, an organic or other third-party certification, or a substitute for any inspection or licence the law requires of your business.

04Farm obligations

  • Your application and every harvest log must be truthful and complete. The declaration you sign in the application forms part of these terms.
  • Samples taken for testing must come from the batch they are recorded against, without selection, substitution, or treatment intended to influence the result.
  • You grant us permission to publish your farm’s name and country, the batch details, the certifications you have told us about, and the laboratory results on the public passport for each batch, and to name the laboratory that produced them.
  • Tell us promptly if anything that could affect a published passport changes — a recall, a lost certification, or an error in what you submitted.
  • You remain responsible for complying with the agricultural, food, labelling, and tax laws that apply to your business.

05Applications, approval, and certification

  • We review applications crop by crop and may approve some crops, deny others, ask for more information, or fill in an application on your behalf for you to check and sign.
  • Approval is at our reasonable discretion and is not guaranteed. We will tell you the outcome, and you may reapply.
  • We may suspend or withdraw approval, and deactivate any QR code, if information turns out to be false or misleading, if a test raises concerns, if a payment is not honoured, or if these terms are broken.

06Laboratory testing and results

  • Tests are performed by independent laboratories. We record and publish results as the laboratory reports them; we do not alter them and do not guarantee their accuracy.
  • A result describes the sample tested on the date shown. It is not a guarantee of the composition, quality, or safety of any other produce, or of the same produce at a later time.
  • Results are shown as measured, without comparison to other produce, and are not nutrition or health claims about the produce.
  • Laboratories using the Platform must submit results honestly, keep farm data confidential, and follow their own accreditation and professional obligations.

07Fees and payments

  • Laboratory tests are paid for by the farm. Before a test is arranged we show you the cost in the currency of the country your farm is registered in, and you authorise it in the Platform.
  • Authorising a test is a binding commitment to pay that amount. We will invoice you or collect payment by the method agreed with you. The Platform itself does not store card or bank details.
  • Amounts exclude taxes unless stated; you are responsible for any tax due on your side.
  • If an authorised payment is not made when due we may pause testing, withhold results, and deactivate QR codes for the batch concerned until it is settled.
  • Fees for other services, if any, will be agreed with you in writing before they apply.

08QR codes and passports

  • Each QR code is issued for one specific batch. Print and apply it only to packaging containing produce from that batch.
  • QR codes, serials, and passport pages remain our property and are licensed to you for that batch only. Do not copy, reuse, resell, or alter them.
  • We decide when a passport becomes public and may deactivate a code at any time for the reasons in these terms or to protect shoppers. A deactivated code shows a generic “not found” page.
  • Using a Climate Support code on produce it was not issued for is a material breach. We will close the account, deactivate every code issued to it, and may inform affected partners and authorities.

09Acceptable use

You must not:

  • submit false, misleading, or someone else’s information;
  • access data or accounts you are not entitled to, or probe, scan, or test the Platform’s security without our written permission;
  • scrape passports or the Platform, or use automated means to enumerate QR codes;
  • interfere with the operation of the Platform or the delivery of its emails;
  • use the Platform for anything unlawful.

10Your data and our content

  • You keep ownership of the information you submit. You grant us a worldwide, royalty-free licence to store, process, display, and publish it to the extent needed to operate the Platform, publish passports, and comply with the law, for as long as the relevant records must be kept.
  • The Platform, its design, code, marks, and the passport format are ours or our licensors’ and may not be copied or reused without permission.
  • How we handle personal data is described in our Privacy Policy, which forms part of these terms.

11Partner obligations

Laboratories, packagers, and shops receive farm and batch information only for the role they perform. Each must keep that information confidential, use it only for that role, protect it appropriately, and delete it when it is no longer needed for that role or when we ask. A partner that mishandles farm data will lose access.

12Disclaimers

The Platform is provided “as is” and “as available”. We do not promise it will be uninterrupted or error-free, and we may change or withdraw features with reasonable notice. To the extent the law allows, we exclude all implied warranties. Nothing in the Platform is legal, agronomic, nutritional, or financial advice.

13Limitation of liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or consequential loss, lost profits, lost sales, or reputational harm, and our total liability to you for all claims in any 12-month period is limited to the amounts you paid us through the Platform in that period.

14Your responsibility for claims

You will compensate us for losses and costs, including reasonable legal fees, arising from information you submitted that was false or misleading, from produce you sold under a Climate Support code, or from your breach of these terms or the law.

15Ending the agreement

  • You may close your account at any time by contacting us.
  • We may suspend or end your access as described above. Where the reason is not a serious breach we will give reasonable notice.
  • On termination, active QR codes for your batches may be deactivated, unpaid amounts remain due, and we keep the records the Privacy Policy says we must keep. Sections that by their nature should survive, including fees, licences, disclaimers, liability, and disputes, continue to apply.

16Changes to these terms

We may update these terms. We will post the new version with a new effective date and, for material changes, notify account holders by email or in the Platform at least 14 days before they take effect. Continuing to use the Platform after that date means you accept the new terms; if you do not, close your account before then.

17Governing law and disputes

These terms are governed by [governing law]. Disputes will be brought before [competent courts], without prejudice to any mandatory consumer or local-law protections you have in the country where you are based. Before starting proceedings, both sides agree to try to resolve the matter by writing to each other first.

18General

  • These terms, the Privacy Policy, and the application declaration are the entire agreement between us about the Platform.
  • If any part is found unenforceable the rest continues to apply.
  • You may not transfer this agreement without our consent; we may transfer it to a successor of the Climate Support business with notice to you.
  • Notices to you go to the email address on your account. Notices to us go to the contact below.
  • Our failure to enforce a term is not a waiver of it.
